1. صلاحية الشروط والأحكام العامة
1.1. الشروط
1.1.1. The AviaPartner website is managed and operated by esimba.ai، مع توفير خدمات الاتصال من قبل نفس الكيان.
1.1.2. These terms and conditions, as may be amended from time to time, shall apply to all services rendered by AviaPartner in connection with the prepaid eSIM profiles provisioning to Clients.

1.2. التسجيل والحسابات
1.2.1. The Сlient may be required to create an account to use the AviaPartner`s services. The Сlient agrees to provide accurate information during registration.
1.2.2. العملاء مسؤولون عن الحفاظ على سرية معلومات حساباتهم وجميع الأنشطة التي تتم من خلالها.
1.3. الخصوصية
١.٣.١. تُنظّم سياسة الخصوصية لدينا جمع واستخدام معلومات العميل الشخصية. باستخدام خدماتنا، يُوافق العميل على سياسة الخصوصية الخاصة بنا.
1.4. الإنهاء والتعليق
1.4.1. AviaPartner reserves the right to suspend or terminate access to the services without notice at any time due to the occurrence of an event arising from network collapse or cessation of maintenance provision.
1.4.2. In using the Services provided by AviaPartner, the Client must not engage in any abusive, illegal, or fraudulent actions or take any actions that could impair or damage the Network. When the Client breaches this obligation, AviaPartner may suspend the Client’s use of the Service.
1.4.3. All bundles offered by TAviaPartner are intended exclusively for use by human Clients. These bundles must not be utilized within any automated system. In situations where usage within automated systems or by non-human entities is requested, the Client must contact Customer Support and request special bundles. Any violation of this usage restriction may lead to the termination of the agreement.
1.5. سياسات وإرشادات الاسترداد والإلغاء
١.٥.١. استرداد الأموال متاح للعملاء في أي وقت. يمكن حل معظم المشكلات عبر البريد الإلكتروني.
١.٥.٢. بعد معالجة طلب استرداد المبلغ، قد يستغرق ظهور المبلغ المُسترد في كشف حساب بطاقة الدفع الخاصة بالعميل من ٥ إلى ١٠ أيام عمل (في حال الدفع ببطاقة ائتمان). أما عبر باي بال، فيستغرق الأمر بضع دقائق بعد إصدار طلب استرداد المبلغ. يتم إصدار المبلغ المُسترد إلى نفس طريقة الدفع (مثل بطاقة ائتمان أو باي بال) المُستخدمة لإتمام عملية الشراء.
١.٥.٣. جميع عمليات استرداد الأموال (باستثناء مدفوعات العملات المشفرة) تخضع لرسوم ١٠١TP3T، وذلك بسبب رسوم بطاقات الائتمان وأنظمة الدفع الأخرى، بالإضافة إلى موارد المعالجة اللازمة لتوفير المنتج ثم إلغائه واسترداد المبلغ.
1.5.4. AviaPartner may offer data in an amount equal to what the Client paid for any accidental purchases.
1.5.5. لا يمكن استرداد قيمة إعادة التعبئة.
1.5.6. AviaPartner reserves the right to terminate services at any time. In such cases, no refunds will be provided.

1.5.9. العملات المشفرة المدعومة: 'USDT (TRC20)'، 'BTC'، 'DAI'، 'AXS (ERC20)'، 'DASH'، 'DOGE'، 'ETH'، 'LTC'، 'TUSD (ERC20)'، 'USDC (ERC20)'، 'USDT (ERC20)'، 'XRP'، 'TRX'، 'AXS (TRC20)'، 'HT (TRC20)'، 'ETH (TRC20)'، 'ETH (BEP20)'، 'DAI (BEP20)'، 'USDT (BEP20)'، 'DESU (BEP20)'، 'ADA (BEP20)'، 'USDC (BEP20)'، 'BTCB (BEP20)'، 'CSC'. يرجى ملاحظة أن هناك حد أدنى للدفع لكل عملة مشفرة.
2. برنامج الشراكة
2.1. By joining the AviaPartner Affiliate Program, the Affiliate Partner will recommend to their users AviaPartner products through their unique affiliate link.
2.2. يجب استخدام رابط الشريك الفريد لتتبع المبيعات وتوزيع العمولات وفقًا لذلك.

2.4. يتم دفع العمولات خلال الأسبوع الأول من كل شهر عن طريق التحويل البنكي أو محفظة العملات المشفرة أو رابط بطاقة الائتمان أو باي بال.
2.5. سيحصل المستخدمون الذين يشترون منتجات eSIM أو يعيدون تعبئة منتجات eSIM الخاصة بهم على خصم عند الدفع.
2.6. AviaPartner reserves the right to modify the terms and conditions of the Affiliate Program at any time. Any such modifications will be communicated to the Affiliate Partner in writing at least five days prior to their implementation.
2.7. AviaPartner reserves the right to terminate the Affiliate Partner’s participation in the Affiliate Program under the following conditions:
- إذا قام الشريك التابع بانتهاك أي بند من بنود هذه الاتفاقية.
– If the Affiliate Partner engages in any activity that is harmful to AviaPartner’s brand or business.
2.8. To commence participation in the AviaPartner Affiliate Program, the Affiliate Partner must accept the invitation to join via the Affiliate Portal.
2.9. The Affiliate Partner will receive an email notification from AviaPartner upon the first product purchase made through their affiliate link.
2.10. The Affiliate Partner can track their commissions at any time using the online daily reports provided by AviaPartner.
2.11. AviaPartner provides access to an API for the Affiliate Partner to use.
٢.١٢. يوافق الشريك التابع على استخدام الأدوات والموارد المُقدمة وفقًا لإرشادات وسياسات Travel eSIM. قد يؤدي سوء الاستخدام أو الاستخدام غير المُصرّح به لشريط أدوات الشريك التابع أو التقارير أو واجهة برمجة التطبيقات (API) إلى إنهاء اتفاقية الشريك التابع.
2.13. AviaPartner will provide necessary technical support and assistance to help the Affiliate Partner effectively use the Affiliate Toolbar, access reports, and integrate the API.
3. برنامج الإحالة
3.1. By participating in the AviaPartner Referral Program, the Partner (hereinafter referred to as “Advocate”) can earn free data for every person who purchases their first AviaPartner product using the Advocate’s unique referral link.
٣.٢. يجب على المُناصر إنشاء رابط إحالة خاص به ومشاركته عبر البريد الإلكتروني، أو وسائل التواصل الاجتماعي، أو المنتديات، أو غيرها من القنوات. يجب على الصديق المُحال استخدام رابط الإحالة للشراء.
شريحة eSIM.
3.3. مكافآت للمدافعين:
أ. قسيمة بيانات مجانية: سيحصل المحامي على قسيمة بقيمة 3 جيجابايت من البيانات المجانية، صالحة مدى الحياة*، وتنطبق على خط eSIM الخاص به.
ب. الشروط: يتم تقديم مكافأة البيانات البالغة 3 جيجابايت عندما يستخدم صديق تمت إحالته رابط الإحالة لشراء eSIM**.
ج. صلاحية القسيمة: قسيمة البيانات صالحة مدى الحياة، بشرط إعادة تعبئة بطاقة eSIM مرة واحدة على الأقل سنويًا.
3.4. مكافآت للأصدقاء المحالين:
أ. قسيمة البيانات: سيحصل الصديق المشار إليه على قسيمة بقيمة 3 جيجابايت من البيانات المجانية لبطاقة eSIM الخاصة به.
ب. قيود القسيمة: لا يجوز دمج قسيمة الإحالة مع أي قسائم أو خصومات أخرى. يُسمح باستخدام قسيمة واحدة فقط (سواءً إحالة أو تفعيل) لكل عملية شراء.
3.5. شروط مكافأة الإحالة:
أ. الحد الأدنى للشراء: يجب على الصديق المحال شراء خط جديد بسعة بيانات لا تقل عن 1 جيجابايت باستخدام رابط الإحالة.
b. Reward Issuance: The reward will be created within 6 hours of a successful purchase and sent via email within 7 days. The Advocate should check their inbox using the keyword “AviaPartner” if they do not receive the notification mail.
3.6. For any issues or further assistance, the Advocate and the referred friend can contact AviaPartner support.
3.7. The Advocate agrees to comply with the terms and conditions of the AviaPartner Referral Program. Misuse or violation of these terms may result in disqualification from the program and forfeiture of rewards.
3.8. AviaPartner reserves the right to modify the terms and conditions of the Referral Program at any time. Any such modifications will be communicated to the Advocate in writing at least 5 days prior to their implementation.
4. إخلاء المسؤولية
4.1. The materials on the AviaPartner website are provided “as is”. AviaPartner makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, AviaPartner does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
4.2. Network operators in countries could be changed by the AviaPartner without notice.
5. القيود
5.1. In no event shall AviaPartner or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on AviaPartner Internet site, even if AviaPartner has been notified orally or in writing of the possibility of such damage.

6.1. The materials appearing on the AviaPartner website could include technical, typographical, or photographic errors. AviaPartner does not warrant that any of the materials on its website are accurate, complete, or current. AviaPartner may make changes to the materials contained on its website at any time without notice. AviaPartner does not, however, make any commitment to update the materials.
7. الروابط
7.1. AviaPartner has not reviewed all the sites linked to its Internet website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by AviaPartner of the site. Use of any such linked website is at the user’s own risk.
8. القانون المعمول به والاختصاص القضائي
٨.١. تُفسَّر هذه الشروط وفقًا لقوانين ولاية ديلاوير، الولايات المتحدة الأمريكية. في حال عدم تمكن الطرفين من حل النزاعات وديًا من خلال المفاوضات، تُسوّى هذه النزاعات نهائيًا عن طريق التحكيم في ولاية ديلاوير، الولايات المتحدة الأمريكية، وفقًا لقواعد التحكيم الصادرة عن معهد التحكيم التابع لغرفة تجارة ستوكهولم.
9. تعديلات شروط استخدام الموقع
9.1. AviaPartner may revise these terms of use for its website at any time without notice. By using this website, you agree to be bound by the then current version of these Terms and Conditions of Use.
